Article 1 – Purpose

These terms and conditions govern sales by the association Fil en Forme, 200 Rue Léon Blum, 69100 Villeurbanne, France.

Article 2 – Prices

The prices of our products are indicated in euros, all taxes included (not subject to VAT), unless otherwise stated, and excluding processing and shipping fees.

For orders placed to a country other than mainland France, you are considered the importer of the product(s) concerned. Customs duties or other local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of the Fil en Forme association. They shall be borne by you and are your full responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these matters with your local authorities.

All orders, regardless of origin, are payable in euros.

Fil en Forme reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time the order is confirmed and subject to availability.

Products remain the property of Fil en Forme until full payment has been received.

Note: As soon as you physically take possession of the ordered products, the risks of loss or damage are transferred to you.

Contractual information is presented in French and will be confirmed no later than at the time of order validation.

Fil en Forme reserves the right not to record a payment or confirm an order for any reason whatsoever, particularly in the event of a supply problem or difficulty with the received order.

Article 4 – Order Validation

Any order placed on the website https://www.filforme.fr implies full acceptance of these Terms and Conditions.
Any confirmation of an order constitutes full and unconditional acceptance of these general terms of sale.

All data provided and the recorded confirmation will constitute proof of the transaction.
You declare that you are fully aware of this.

The confirmation of the order will constitute a signature and acceptance of the operations carried out.

Article 5 – Payment

Validating your order implies your obligation to pay the indicated price.

Payment for your purchases is made by credit card through a secure system or via a third-party payment plugin if available.

Article 6 – Withdrawal (Right of Cancellation)

In accordance with Article L.121-21 of the French Consumer Code, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal.

Returns must be made in their original and complete condition. In this context, your responsibility may be engaged. Any damage may result in the loss of your right of withdrawal.

Return shipping costs are your responsibility.

In the event of exercising the right of withdrawal, Fil en Forme will reimburse you within 14 days.

Exceptions to the right of withdrawal: see Article L.121-21-8 of the French Consumer Code (personalized, perishable products, etc.).

Article 7 – Availability

Our products are offered as long as they are visible on the website https://www.filforme.fr and within the limits of available stocks.
In the event of unavailability, you will be informed and refunded.

Article 8 – Delivery

Products are delivered to the address indicated during the order process. Delivery times are given as an indication. In case of delay, an email will be sent to you.
In the case of deliveries by a carrier, Fil en Forme cannot be held responsible for the client’s unavailability.

Article 9 – Warranty

In accordance with the law, Fil en Forme provides the legal warranty of conformity and warranty against hidden defects.

Article 10 – Liability

Products comply with French legislation. Fil en Forme declines all responsibility in the event of non-compliance with the legislation of another country.

Article 11 – Applicable Law and Jurisdiction

The language of this contract is French.
This contract is subject to French law.
In case of dispute, the court of Lyon shall have sole jurisdiction.

Article 12 – Intellectual Property

All elements of the website https://www.filforme.fr are and remain the exclusive property of Fil en Forme.
Any reproduction or use is prohibited without written consent.

Article 13 – Personal Data

Fil en Forme reserves the right to collect personal data.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to your personal data.

Article 14 – Archiving and Proof

Fil en Forme will archive order forms and invoices on a reliable medium.
The computerized records will be considered proof of communications and transactions.
